What is the solution for this?

my deceased father had a flat in mumbai. he had made WILL. but i was not aware of that. After my father's death co-op hsg society has transfered the said flat on elder brother's name according to will. In this case is it fruitful to fight for the flat or why probate procedure is not followed?
