Needing general information regarding the probate laws in the state of Missouri. My husband's mother passed away on the 18th. Her husband of the last 9 years has basically shut us out and even ignored calls from us. He has not opened the estate, but we were advised by an attorney to file to open the estate and have my husband appointed as the representative of the estate. Any information on this process would be greatly appreciated.

He advocates a "fair tax". It is not a fair tax like what Ron Paul has talked about where everyone would pay a set amount. He instead sets it at 23% rate and offers probates for low income families. This means that low income families wil pay no taxes, just like in the current system. The problem is that right now the top earners pay something like 39%. His proposal would drop that tax rate down to 23%. That is a massive tax break for the rich, without any plan to make up that lost revenue. I support Ron Paul, but I Am not above listening to new ideas. Cain's plan however seems to just replace the IRS with a system that does the exact same thing but taxes the wealthiest by about 40% less. I am all for lower taxes for everyone, but his plan looks like disaster. Why is no one calling him out for it?

I have a legal question concerning executing a will?

My mother recently passed away and I am the executor of her estate. When I executed her will at the courthouse, they informed me that I could only pay up to $3,500 towards her funeral expenses. She had two life insurance policies with no beneficiary that she bought to cover the cost of her burial. Can I go ahead and sign those over to the funeral home without fear of being held in contempt? I'm a Nursing Home Administrator I've seen alot of negative things happen to families because they don't have advanced directives or will's or even power of attorney's. We'll start with advanced directives. If a patient hadn't declared what they want then the medical community will do normal protocol. Ex. If a patient has a heart attack, the medical team with revive them to the best of their ability even if it results in brain damage and the patient living as a vegetable or with horrible damages. The process of reviving normally includes cracking the rib cage and a very painful recovery with time in rehab. If the patient ends up as a vegetable with out a living will, they will remain on life support until they die or the doctor decides to cut the cord. Once the patient as passed away the state takes all their assets instead of the family with out a will. And if there is someone you don't want to lay claim to anything... you have no way of dictating that with out a will. The advanced directives let's you choose if you want to be brought back during certain situations like respiratory arrest vs. cardiac arrest. The Living will then deals with the after math of that in that you can designate someone to make decisions for you ONLY WHEN YOU ARE NO LONGER ABLE TO MAKE THEM YOURSELF. Having a Power of Attorney or Living will doesn't mean you sign over your right all it means is that if you are ever unable to make decisions (ex, Alzheimer's, acoma etc...) then someone you trust can make the decisions you would want to have made. Their job is to carry out your wishes not their own. The will is the icing on the cake, it lays out what you want to happen to your things once you are gone. That way it doesn't go to the state first for review, your lawyer has set out the terms and what goes where. If you don't care you can simply put, split my assets evenly between my children. It's simple. I'm 26 and I have a will, I have a power of attorney and advanced directives. It's never too early. I have patients from 24-104... everyone should make their wishes known and if you ever change your mind, you can change all of those things as well.

So, a friend who takes adderall just came over and had a glass of wine w/ dinner and smoked a few bowls w/ us. He then sat back slowly on the couch, put his head back and went white, eyes open, pupils dilated, mouth open, GHOST WHITE. I thought he was choking, because there was like no breath coming out of his mouth, so I tried CPR (or some awful attempt at it). He then slowly looked at us, and sat up. He is now really white still (color came back, then left like 15 min ago), feels nauseous and is just slumped over not feeling well at all. He said he felt dizzy before it hit, tingling in his brain, and saw it coming, but couldn't do or say anything. He said its happened once before, but not like that. What should we do for him? Re: Legal Notice For Administrator Of An Estate?

My sister passed away last month. I have signed the paperwork to be the administrator of her estate. It was signed the week of May 9. The paperwork was carried to the probate court in the adjacent county. The judge was vacation that particular week but has returned. In my opinion, there has been more than enough time to sign the paperwork and submit it to the local paper for the legals section; however, the judge has failed to do so. Is there a time frame involved here? Once the papers are signed, how long does probate court have to get the legal notice in the legal organ? I have reason to believe there is some stalling here both on the part of the judge and on the part of a third party who was not related to my sister who's trying to cause me trouble. If the judge is not going to do her job, seems they would need to notify me. I feel like I should drop the whole matter; it's my opinion this judge could be crooked.

So basketball season is over, and the articles about Lebron James just keep rolling. I mean seriously people, just stop already. Never have I seen so many people scrutinize one player based off ONE series. So what if it was the finals, Lebron went into a slump just like any other play could have, and it just so happen to be in the finals when he went into it. Now people are saying Miami should trade Lebron to Orlando for Dwight Howard...lmao seriously???? Yes, I do believe Lebron fell short in the finals and definitely didn't deliver when he was really needed...but people are so quick to forget how great he was during the season and in the series against Boston and Chicago. Don't get me wrong, Dwight Howard is a great player, but if I had to choose between him and Lebron..it'd be Lebron every time for me. Howard can provide a great inside presence, but LeBron is the the better all around player (hence the 2 MVPs). LeBron is a great player, possibly the best in the game right now. Anyone who says LeBron needs to get out of Miami just because they didn't win a title in their first year...is dumb. Period. LeBron will have his time and his ring all in due time, and people need to lay off the insults and the articles analyzing everything he does because it really is getting old, and fast. Next season will be another great season for the Heat WITH LeBron on the team. So bascially I'm just tired of all the people who rooted for LeBron to fail saying how they will never win a title (very unlikely btw) and how it serves LeBron right to lose in the finals. All I see when I see people act like that, is people who are just upset b/c LeBron left or didn't choose them as his next team to play on. He's on the Heat, hes staying on the Heat, get over it. Im a junior in high school and my grades have taken a major nose dive(I have had a 2.5 just about every year). It is 2 days till summer so there is no way to get them up. I've never been in a relationship or anything close to one, so I can't help you there. I have very few friends and am the shyest person at my school. What might cheer you up is joining a club with some people you may know, even if you barely know them. You will be able to socialize with people and gain some confidence. When people see you are with others, they will see you are likable. If you have a phone that would help. I was really depressed in school. When first semester finished, I joined a club. I knew one person in there. Then I learned my neighbor was in there. After about two weeks I knew practically everyone in there and felt good about myself. If it helps, I joined newspaper. Just try joining something and you'll feel better.

Speak to the solicitor handling the will and he will be able to charge the mortgage costs against the estate.

I see what your problem is, the same thing is happening to me...So, first try to see if there is any added stress in your life, if there is, don't think about it as much. Second, practice more with your subjects. It doesn't always matter if the study habits you had before worked, with the harder material you may need to chang them. Try a different type of studying, eg. flash cards. Also, for example in math, you can check to see if you really have the skill down, you do this by finding an online calculator service and you give yourself a problem. If when you put the problem into the calculator your answer is the same over and over and over and over and over again(100% of the time) you have the skill down pat. Hope this helps!!!

Advice for a beginner guitarist?

So I just got my first ever guitar (a Fender Acoustic) in the mail yesterday. I played it for 4 1/2 hours straight using online guitar lessons, took a break, then played for about another 2 hours.. Then today, I played for a good 6 hours total. I learned a lot about the basic chords and strumming as well as reading tabs and understanding how to play a basic song. But the problem is, I can't play any songs! It's sooo hard to move from one chord to another fast enough.. I know that this takes time and lots of practice, but I was wondering if maybe anyone had some advice that would help me get past this slump.. It sucks because I feel like I learned so much in one day, and know I'm stuck for who knows how long just to move from one chord to another.. Should I invest in lessons? I really can't afford them right now, but if anyone that's experienced thinks they would help me more than I can myself, then I'll start saving up.. Am I doing something wrong?? Any good free online sites worth checking out? Or maybe some really easy songs I could start to practice (other than the most common ones you'll find by a simple google search)? My mom is not supportive of me dancing, what should i do?

My mom isnt supportive of me dancing, writting,acting or anything else that is not swimming. She is very, EXTREMELY supportive of me swimming even though I haven't been doing that great(been in a slump). Hello to all from Yahoo. I recently just graduated college from Indiana University with a Bachelors in Media Arts & Science. I come from a family who has a military background (Great Grand Father was a Tuskegee Airman) and my mother has always told me that the Air Force is such a unique and great experience that will really get me to focus, and at the same time continue my dream as a Graphic Artist. I've heard great things from friends as well who've been in the air force and recommend that with my background in computer work, I should check into it as well. Are there signs / warning before a baby goes into seizure?

My 2yrs 6mnths baby recently had a 2nd seizure (the 1st attack was 5mnths ago) caused by fever as according to his paeditrician, seconds before the seizure i could've sworn i saw him having difficulties grabbing his drinking cup (he cant open up his thumb), in a split second he responce in grabbing the cup seemingly well, then i saw him walking in a slow-motion manner (like he was walking n suddenly decided to freeze while walking) and then continue walking again, about 8seconds after that he slump down onto the floor with seizure attack! What is wrong with my ferret?

My ferret has no energy what so ever...when I take her out to play she just slumps around, much unlike her old self that would bounce, hop around, and lick you whenever she was taken out. My Aunt died in November 2009 and named my father as one of her beneficiaries on her ALCOA retirement. Unusually tired lately, dont know whats wrong.?

HI. Lately i have been noticing very strong fatigue. I am a VERY active person and usually have the right amount of energy to get me through my day. lately i have been getting the right amount of hours of sleep. go to bed at 10 wake up at 7:15 - 7:30. I am slightly overweight but have recently had bloodwork done and everything is perfect. bloodsugar, cholesterol and thyroid are perfectly normal. like i said earlier, im very active. at one point i was doing 2 workouts a day about a month ago but now have rounded it down to one vigorous workout a day with the exception of maybe two a day once a week. working out is my passion i am also a trainer for many friends and family members of mine. Another thing to add is i was very stressed the past year with school but now it's summer and i feel very relaxed and havent been stressed for 2 weeks now. i do have a slight allergy to wheat and gluten which i know is known to cause some fatigue but lately its been extreme fatigue. my muscles are sore, i feel like just lying down if im out shopping. i was sitting on the couch and felt myself slumping down and trying to keep my eyes open at 7:00 at night! walking up the stairs was even tiring for me and usually i take two at a time no problem! this morning at the gym i was so tired after only 30 mins of cardio. i usually do an hour or an hour and 15 of cardio and 30-45 mins of weight training! i just would like to know if maybe there is something i could do to make myself more energized or if i need to get something checked out by a doctor? One more thing to add is i am 16 years old.

I am the sole fiduciary for my Grandmother's estate. She passed about 1 1/2 years ago. My grandmother's will was set-up as discretionary trusts for my Dad and my Aunt with stipulations about distribution (although totally discretionary). My father has been really a pain in the *** to deal with on this. He fails to realize that all of her property passed into my possession as sole fiduciary. Softball Player Help NEEDED?

I actually just quit my school team a couple of days ago. I have played softball for 12 years of my life, eight of those being travel. I've started on my travel team for 8 years straight. Then I tried out for varsity softball at my highschool. I barely made it and sat the bench my entire sophomore year. I figured it was since I was an underclassmen and tried out this year as a junior. I hit well in practice, worked so hard, and played maybe 10 innings total out of 25+ games. I was going to miss a sectional game for a travel tournament, so they told me if I did, I should just hand in my uniform. I told them I didn't do anything the whole season and they told me I did plenty. I literally was a pinch runner (I am not fast at all...) so I told them I was leaving. They told me I would have started if I had went to a game that I had missed (I was sick... and it was a scrimmage..) which I thought was bull. My dad was freaking that they gave me an ultimatum. I really love not having to work hard for no reward. There's some summer leagues that offer fundraising options for you to be able to play. We do hot dog sales, candy bar sales, etc to be able to afford travel. If you find a summer league you really like and the coach wants you, they'll work with you to help you afford it.

I was divorced for 12 years. I didn't expect to ever love like I loved my husband of 20 years. I have dated a lot but until last February I had never fallen in love again. Have you tried lying down on the floor where she can see you? If I remember correctly your former question, you give her milk to help her fall asleep? So it sounds like she needs to learn to fall asleep on her own without any 'crutches' if that makes sense. You could lie down and have her lie down too, keep physical contact to start with, then gradually move further as the days go. That way she will learn to fall asleep on her own without feeling 'abandoned'.

Basically a close family member passed away last year and the solicitors have been dealing with the estate. Long story short i received a letter a couple of weeks ago basically stating probate had been granted, everything was sorted the solicitor was just tieing up loose ends.. collecting the money in the estate from the bank accounts and would take his cut owed and distribute the money to me. Loss of my inheritance?

My uncle passed and I did not want to particiate in the court battle regarding his will and a complaint in equity with other family members. Because of this I did not receive an inheritance from his estate. I was told by the court appointed probate attorney that because "I did not hire an attorney; did not come to Court to be heard after notice being sent in the Will contest and Complaint in Equity. By not participating, legal rights get lost". I don't think this is fair. Wrongfully declared dead?

I have a relative who was declared dead in error. It's a long story, but he was in an accident and suffered some memory loss. We discovered that he is a alive and he found his way back to us. The problem is that a death certificate was issued and his property and assets were distributed by the probate court. Question about inheritance and probate?

My grandmother that raised me my entire life just passed away two months ago and things have been hectic ever since. One of my 4 uncles is the exectutor of her estate, and he is trying to do everything he can to get anything for nothing. My grandmother left me her house in her will, and her will was reviewed for wording by a probate lawyer last week. The lawyer told me that based upon the wording of the will that the executor of estate had no privledge to sell the house. I have already aquired all paperwork filed at the court house, and the lawyer looked over that as well and did not see anything that gave him permission to sell the house. The main question is, she has a car worth $5,000 that is paid off which was left to the exectutor in the will as well. He has mentioned keeping the car (not selling it), or selling it to an outside person for $2 until the probate process is over and then the individual reselling it back to him. He is trying to prevent me from getting the house by taking the car knowing that I cannot come up with the value of the car to close out the estate. Is it estimated that she has around $4,000 in debt including the attorney. What i'm saying is, and what whas explained to me by the lawyer..... real estate is the last thing in probate that can be sold, cars have to be sold before real estate. Can he do the $2 purchase of the car and pass on the $4,000 to me knowing that I cannot pay that? If he sold the car, the estate would actually be in the positive around $1,000 allowing the estate to close and me to acquire the house. The executor is also saying that he has paperwork saying that if the house is sold, the money is split between the four biological sons of my grandmother instead of me. This, however, was not filed at the courhouse. He is basically trying to get a car for free and get a cut out of what belongs to me while leaving me with nothing.

Switching from low carb to low calorie a bad idea?

i have been eating low carb for probably 5 months now. i have lost about 30lbs so far. im sort of in a slump with it though. its not that i miss a lot of carby foods, but i miss being able to have options with food. ive found that im limited to what i will eat. i know there are a ton of low carb foods and recipes out there, but im picky so im bored with what i will eat. ive been debating going back to eating low calories. i weigh 155lbs now and im 5'2''. im at the lowest weight i ever have been and i feel a lot better, but my goal is 140lbs. i do also have a timeline. i would like to lose 1-2lbs a week and weigh 140lbs by august because my bf is coming home from deployment. i used to lose weight just fine eating low calorie but since ive had a baby, it doesnt come off as easy that way. low carb has really helped since then. my only worry is that since ive been low carbing, if i eat a few too many carbs one day, i will gain a lb the next day. so im scared of switching and gaining a bunch of weight again. how would i make the transition and still lose weight? also, how many calories should i even consume per day to lose 1-2lbs/week?
